Carry Bags We encourage our customers to carry their own carry-bags, while placing the orders at our physical stores. This small gesture will go a long way in saving the environment. However, if the customer still wishes to exercise the option of availing a carry bag provided by us, please note that such paper carry-bags are chargeable by the restaurants. Such chargeable paper carry-bags provided by the restaurant at the request of the customer typically do not carry the KFC brand name and are charged to merely recover the cost of the carry bag which does not form part of the product cost

For the home-delivery orders placed via our Site, the price of the carry bags is mentioned in the invoice value at the checkout page, and you are requested to please ensure that you review the charges before finalizing your cart and placing the order. Your placement of order with the said carry bag charges shall amount to acceptance of the sale contract to this effect by you.

Indemnification You agree to indemnify, defend and hold harmless us and our franchisee/s, affiliate/s, directors, members and any persons, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, from any cause of action, claim or demand, including attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms and Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Severability In the event that any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions whatsoever.

2. Home Delivery T&C

Home Delivery channels

KFC India is running KFC Home Delivery Service (hereinafter referred to as “KFC Home Delivery”) via following channels (through its franchise partners and its equity owned stores in India):

a. KFC India website viz. https://online.kfc.co.in/menu and/or

b. KFC India mobile site viz. https://online.kfc.co.in/menu; and/or

c. KFC India mobile applications viz. KFC Online Food Ordering, for IOS; and KFC Online Order and Food Delivery for Android.

d. KFC call center number for home delivery on 08042754444 (the “KFC Home Delivery Call Center”). Customer may also call on this phone number for their grievances or queries.

The acceptance of order shall be at the entire, sole and absolute discretion of KFC India. KFC India further reserves the right to refuse or to accept or to cancel any order from any customer beyond the delivery area, without assigning any reasons. It shall be the sole and absolute responsibility of the customer to ensure that delivery instructions are clear and precise.

It is clarified that KFC Home Delivery is not available at all restaurants of KFC India. To check whether KFC Home Delivery is available in your area, customers need to refer to the information and details disclosed in the respective KFC Home Delivery channels, as disclosed above.

Delivery policy:

The Delivery is subject to:

i. Customer addresses falling in the delivery area (area within which KFC Home Delivery is available) of the nearest restaurant. The delivery area is defined from time to time by KFC India at its discretion and is subject to change.

ii. The delivery address being mapped to the nearest restaurant that delivers in customer area.

iii. Availability of KFC India products and services.

iv. Availability of the restaurant as online to take up the delivery.

v. In case the delivery locality is not listed in the restaurant map, delivery orders cannot be placed. However, you may choose to pick up your order from the nearest KFC India restaurants, if this service is available at the respective KFC India restaurant.

Once the order has been placed successfully it cannot be changed or cancelled by the customers for any reason. You may get updated on the status of the order by calling the restaurant directly.

KFC India shall use its best efforts to meet the scheduled delivery time and at times the delivery schedule may also be conveyed by the KFC Home Delivery Call Center on the phone to the customer, however, it does not guarantee these delivery timelines in every case. KFC India shall not have any liability to customer if the customer's order fails to meet in whole or in part such scheduled delivery time.

It is customer’s responsibility to ensure that customer himself/herself or an appropriate person is available at the delivery address and he/she must pay in full for the order placed through KFC Home Delivery channels. If customer or appropriate person fails to be present for KFC Home Delivery, KFC India is entitled to charge the customer in full the amount of order, the cost of delivery and any other charges that may be levied from time to time for the KFC Home Delivery.

KFC India reserves the right to reject the Delivery order or to cancel the same once it is accepted:

a. In case of customer ordering through KFC Home Delivery Call Center, KFC India is unable to contact the customer due to any reason whatsoever on the mobile / landline number of the customer as provided by the customer at the time of placing the order; or

b. In case of non-receipt of payment in full or in part in any previous order or the current order; or

c. In case of abuse to any employee/ representative /riders of KFC India in any previous incident; or

d. If there is a trend of order cancellations; or

e. If there is a trend of frequent frivolous complaints and consequent replacements; or

f. If customer has provided wrong, inaccurate, incomplete or incorrect address; or

g. If customer’s address is not falling in defined delivery area of the nearest or any other restaurant or beyond the delivery area of KFC India; or

h. In view of difficult operating conditions for KFC Home Delivery like heavy traffic or bad weather condition or New Year’s Eve, during festivals like Holi, Ganesh Chaturthi, Christmas, Diwali and Navratri, etc., or in instances of political rallies, processions etc.; or

i. KFC India reserves the right, in its sole and absolute discretion, without limitations, conditions and/or qualifications, and without need of prior notification, to limit, change, modify or cancel any order, and/or to refuse any service to any customer for any reason attributable to circumstances and conditions beyond the control of KFC India which would render order fulfilment impossible or delay the fulfillment of its obligations; or

j. In any other event at the sole discretion of KFC India, without the need to assign any reason or explanation.

We request the customers to note that menu and prices are subject to change without any notice. Therefore, it is the responsibility of the customer to keep himself/herself informed of such updates and check the items in the cart before placing the order for KFC Home Delivery. There can be no cancellation or modification of the order, once placed.

KFC India may change the terms of, or add new terms to, these Terms and Conditions for KFC Home Delivery (“KFC Home Delivery Terms and Conditions”) at any time, with or without cause, and without giving notice. These KFC Home Delivery Terms and Conditions have to be read in conjunction with our Privacy Policy, General Terms of Use, Disclaimer, offers related terms and conditions, and any other terms and conditions as available on the KFC India website and that may be amended by KFC India from time to time. Therefore, it is the responsibility of the customer to keep himself/herself informed of any and all such updates.

Pricing and Payment

The price of KFC India products in all states where KFC India is operating its restaurants is exclusive of the Goods and Services Tax (GST) at applicable rates.

The price of KFC India’s products and services is exclusive of ‘Restaurant Handling’ charges. The customer is liable to pay Restaurant Handling charges (on the order placed through KFC Home Delivery) as applicable in that particular area.

Upon delivery, customer shall pay in cash all charges, including but not limited to Restaurant Handling charges mentioned above, incurred in connection with the order. Alternately, while placing the order on the eligible KFC Home Delivery Service channels, customers may choose the online payment option, upon which they shall be redirected to an external payment gateway, on which they are required to follow the payment gateway’s separate instructions for effecting online payment. The payment gateway is not under KFC India’s purview, control or discretion, and KFC India is not responsible for and shall not be liable to any extent or in any manner for any payment-related or internet-related issues faced by customers in relation to online payments including payment refunds, and customers shall indemnify and keep fully and effectively indemnified KFC India and its affiliates in this regard.

In case the order which is paid through digital payment method is cancelled due to non-availability of the ordered product at the restaurant or any unforeseen circumstance which renders the order fulfilment impossible on part of KFC India or the restaurant, the amount will be returned by reversing the transaction by KFC India restaurant. This refund will be returned on the actual source within 5 to 7 working days. However, KFC India is not responsible for any delay on the bank’s side or on third party payment gateway’s side.

KFC INDIA reserves the right to send to the customers registered with KFC Home Delivery Short Message Service (SMS) regarding the order placed, even though the mobile numbers of such customers may be registered with the DND (Do Not Disturb) services. However, if the customer does not wish to receive the promotional electronic mails, he/she can unsubscribe from the same.

By registering for KFC Home Delivery, you allow KFC India to contact you for offers and updates relating to your account.

Further information on how we use your personal information when using our Internet ordering system:

i. When using the online services for availing KFC Home Delivery, additional information is collected when you place an order online. This information assists in the delivery to your door and to verify your credentials. The internet order system also stores information about your order to help you remember and re-order the same menu in future.

ii. Credit card, debit card and other payment gateways or mechanisms including netbanking details: KFC India does not store any of your credit card, debit card, cash card or other mechanisms including netbanking details. We work with third-party secured payment providers to handle online transactions who might store card information based on the user’s consent.

In case of any dispute with respect to KFC Home Delivery, the decision of KFC India shall be final and binding on all concerned. Disputes, if any, are subject to the jurisdiction of the competent court/s at Delhi only.

If KFC staff is unable to contact the customer, he/she will have to pick up food directly from the store.

Order will be valid for maximum of 2hr from the selected time for self-pickup from the store. No refunds applicable.

Customer might be asked to step out of the car to receive food- for his/her own safety and to maintain social distancing.

Parking and waiting will be at customer’s own risk. KFC shall not be responsible for any kind of damage, theft of vehicles parked for collecting the orders.

Contactless Delivery:

This service is only available on prepaid order; not applicable on payment/cash on delivery orders.

This service is not available on orders places through third party platforms like Swiggy, Zomato, etc.

This service is only valid on deliveries and not applicable on dine in and take away.

Products offered are meant for immediate consumption only.

4. Express Pickup T&C

1. 1. This offer entitles to customer for 1 (one) piece of hot & crispy chicken in KFC restaurant (11 am to 11 pm only) subject to following terms and conditions (Offer). In case of non-availability of hot & crispy chicken, customer can choose 1 (one) coffee mouse cake dessert.

2. Offer not valid on the orders above Rs.1000/- , excluding tax.

3. The Offer can only be redeemed once, per user, per SMS. The customer can avail one free hot & crispy or one coffee mouse cake dessert instantly and only once, per user, per SMS, if the order is not delivered as per the timelines of this Offer. 4. The time-period of 7 minutes is calculated after placing the order and from the time of receipt of the SMS on the phone number shared by the customer on the kiosk or at the front counter to the cashier.

9. A customer intending to avail this Offer acknowledges and agrees that all concerns and disputes related to this offer shall be subject to exclusive jurisdiction of Courts at New Delhi.

10. The customer also acknowledges that the store/restaurant where this Offer is being run shall be responsible for fulfilling it. The liability in regards the franchise run-outlets shall not be with Yum Restaurants India Private Limited or its affiliates, and shall vest with such franchise partners only.
